Copyright & DMCA Policy

 

Connect Holding II, LLC d/b/a Brightspeed and its affiliates (collectively, “Brightspeed”) respects the intellectual property rights of others and is committed to complying with U.S. copyright laws, including the Digital Millennium Copyright Act of 1998 (“DMCA”). The DMCA provides recourse for owners of copyrighted material who believe their rights under U.S. copyright law have been infringed on the internet. The following defines the Digital Millennium Copyright Act Policy (the “Policy”) of Brightspeed, Brightspeed- and its affiliates, including CenturyLink, CenturyLink Fiber, Quantum Fiber, and other brands and entities listed below or whose Acceptable Use Policies link to Brightspeed’s website.

This Policy relates to the use of Brightspeed’s (and/or its affiliate’s) network, websites, systems, facilities, products, and services. Brightspeed will terminate the subscriptions of repeat copyright infringers. Brightspeed’s copyright compliance policies do not affect any other rights Brightspeed may have under law or contract.

Brightspeed reserves the right to suspend or terminate, in appropriate circumstances, the service of users whose accounts are repeatedly implicated in allegations of copyright infringement. If you believe that any activity on any one of Brightspeed’s networks violates your copyright, please submit a notification pursuant to the DMCA (“DMCA Notice”) by providing the following information:

 
  • Signature. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of Copyrighted Work(s). Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  • Identification of Infringing Material. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Brightspeed to locate the material;
  • Contact Information for Complaining Party. Information reasonably sufficient to permit Brightspeed to contact the complaining party, such as address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted;
  • Good Faith Statement. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • Statement Under Perjury. A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If you fail to comply with any of the above listed requirements of Section 512(c)(3) of the DMCA, your DMCA notice may not be effective.

After receiving a DMCA Notice regarding repeated infringement through unauthorized file sharing, including peer-to-peer file sharing, relating to a specific subscriber account, Brightspeed will take action to prevent repeated infringement. Such action may include temporary or permanent termination of the subscriber account.

Under the DMCA, anyone who knowingly makes misrepresentations regarding alleged copyright infringement may be liable to Brightspeed, the alleged infringer, and the alleged copyright owner for damages (including costs and attorneys’ fees) incurred as a result of the misrepresentation including under Section 512(f) of the DMCA.

Please note that Brightspeed, directly and/or through its affiliates, is a service provider of transitory digital network communications as contemplated by 17 U.S.C. § 512(a) of the DMCA. It is therefore not obligated to respond to any demands regarding, and has no duty to block, remove, or disable access to, material that is transmitted over, routed over or sent via connections to Brightspeed’s network(s), by a user or at a user’s direction or initiation. Given the large volume of such notifications it processes, Brightspeed does not respond to status inquiries made in connection with any individual notification or series of notifications.

Counter Notification To Claimed Copyright Infringement

If a copyright infringement notice has been wrongly filed against you as a result of mistake or a misidentification of the material, you may file a counter notification with the relevant Copyright Agent listed above. The counter notification must provide the following information:

  1. Physical or electronic signature of the subscriber;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. The subscriber’s name, address, telephone number and email address, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification or an agent of such person.

There are substantial penalties for sending false notices.
